TERMS OF SERVICE … Important (Please Read)

By using CreatoorsVault.com, I understand and agree to the following terms of service:
I (hereafter referred to as “Member”, “User”, “Writer” or “Creator”) am submitting to CreatorsVault.com (hereafter referred to as “Company” or “CreatorsVault.cm”) certain original creative property for the purpose of registration archival within the company’s secure database and hosted server. In doing so, I understand and Agree with all of the terms and policies set forth by CreatorsVault.com
The Company makes no claim or representation that registration archival of my creative works within the website will prevent infringement by any third party that I, as Member, may inadvertently or purposely exposed my creative works to. The Company provides only a safety method of registration archival to establish the date/time and content of my creative material submitted to the website.
I understand and Agree that it is my sole responsibility to retain my own original copy of materials submitted. Only upon formal written request by a legal representative, arbitration panel, or court order will the material be released in copy from out database with original registration record, as to not compromise the integrity of our service or negate the admissibility of the writer/creator’s work as a piece of evidence in any legal dispute or arbitration process.
As a Member of CreatorsVault.com I understand that I may receive direct information from the Company in the form of Company Newsletter or other industry related items. The Company will not release, trade or sell my email address or registration information to any third party. I understand that within the industry of organized creative forces, it is possible for multiple entities to create similar concepts, stories, scripts or other intellectual properties at the same or similar times. I understand and Agree that the Company is in no way responsible for, or in knowledge of the contents of any material submitted for registration archival.
Mediation/Arbitration – The Company and Member agree to first attempt a mediation of any dispute covered by this Agreement. Mediation is a non-binding process allowing the parties to resolve claims without excessive cost, time and emotion. The mediation shall be conducted pursuant to the Rules and Procedures of the American Arbitration Association for the resolution of disputes, or as other specified by the parties. The parties agree to make a good faith effort at mediating any dispute prior to filing a claim for arbitration.
The parties agree that all references to the “Company” in this Agreement shall include all of its subsidiary and affiliated entities, including all former, current and future officers, directors and employees of all such entities, in their capacity as such or otherwise; all benefit plans and their sponsors, fiduciaries, administrators, affiliates and agents, in their capacity as such or otherwise;
and all successors and assigns of them.
Rights – Please understand that by agreeing to this, the Company and Member waive any right that it, and he or she may possess to have disputes litigated in a court or by jury trial.
Statute of Limitations – Any claim governed by this Agreement shall be filed no later than 30 days from the date of discovery. Location of Arbitration – The parties agree that any arbitration dispute shall be held in proximity to the location of CreatorsVault.com (currently San Diego, CA).
Representation – Each party may be represented by an attorney at any mediation or arbitration covered by this Agreement.
Term, Modification, and Revocation – This Agreement can be modified or revoked at any time by an executive officer of the Company that references this Agreement and specifically states an intent to modify or revoke this Agreement.
Privacy – The Company acknowledges it receives personal information when you register with its service. When you register you are asked for information such as, your name, email address, zip code, phone number etc. The Company also records IP Addresses during the registration process for marking of registrant and as unique identification supporting our service. The Company does not ask for sensitive identifications, such as Social Security# or Driver’s License#. The Company does not sell, rent or share personal information about you to other people or entities; Even when we have your permission, or under the following circumstances’:
  • Company does not disclose the content or details of intellectual properties archived in our
    Secure database.
  • Only in response to subpoenas, court orders, legal process, or to establish or exercise our legal rights to defend against legal claims that may require release of such materials.
  • We can transfer information about you if the Company is acquired by or merges with another company.
Refund/Chargeback Policy – Once your CV Certificate and Personal Account Login is emailed to you, which establishes your registration archival for your work, the Registration is deemed complete. There will be no refund. Chargebacks by your financial institution carry added fees, and the Company will dispute and reverse these by digital proof of use of our service. An additional $25 reversal fee may be force-charged to your account in the event any chargeback reversal acceptance. Upon registration and submission of material to the Company website “CreatorsVault.com” I understand that I am fully bound and obligated to the Terms of this Agreement.

Effective June 24, 2006 to Present
